Divorce. A tough and trying time even for the most steady. What will happen to my property? What kind of money will I be entitled to or have to pay? Mr. Beguelin is a licensed Nevada attorney in good standing since 1989. He practices before all state courts primarily in the area of divorce and domestic relations. There are many different issues in any given dispute and no two divorce cases are alike. He devotes substantial time to listening to the client and identifying the relevant issues in each and every case. While an out-of-court settlement is always better for the client, both emotionally and financially, if disputes cannot be resolved by informal means, then a judge will be asked to decide the cause. A respected Judge in Reno, once said, "the best decision that can be made in a domestic relations case is one that upsets both parties."  Rarely is there a "winner" or "loser." Domestic relations litigation can be costly- not only monetaruly, but emotionally as well. Mr. Beguelin always explores non-judicial methods to resolve a dispute first and foremost, unfortunately, some disputes must be decided by a Judge. Sometimes a client is involved in a domestic disturbance, as the victim or the person accused of the violence. We take these charges very seriously and assist the client thru such challenging times. A restraining order can have a serious impact on a person's rights to possess a gun, custody of children and freedom of travel.

Domestic relations cases often involve matters related to the care, custody and control of minor children. It might involve a divorce with no children. Or it can be a custody and support issue between parties that were never married. It an can involve a modification of a former court order, or enforcement of an order for non-compliance by the opposing party.

A divorce with children will require the judge, in addition to dividing property and allocating debt, to decide the custody of the minor children. There are two forms of custody: legal custody- which involves a right for both parents to have access to medical and educational records and to be consulted for major decisions affecting the child, and physical custody- which is defined by where the child lives and with whom. Traditionally one parent was a primary custodian and the other vested with defined visitation, which can include regular ongoing visits plus holidays, summer and the like. Over the last five years those lines have become blurred and many parents physically share their children, whether it is truly equal time between both parents or some combination of time. Equal time does not mean no child support. Where the parties have at least 60% of the time with the child (and the other party has at lest 40%) each will owe the other child support. Both obligations are calculated and the party with the greater obligation pays the other the difference as an equalizing payment. Child support is based upon the number of children- the more children, the more support that is owed. Where the parties do not have at least a 60/40 timeshare of the children, the parent with the least time will owe support to the custodial parent regardless of that parties' income. Child support is generally not taxable income to the recipient and not deductable by the payor.

Child support may be modified upon a showing of sufficient change in circumstances (for example, loss of a job, etc.) or every three years after entry of the support order. Support must continue until the child reaches age 18, or 19 if the child is still in high school at that time. There are limited circumstances when support can extend beyond those ages, such as where the parties agree or if the child is handicapped under state law.

Any order involving minor children must include a provision for health insurance and the monthly premium must be split together with any medical expense not covered by the policy. The order must also allocate how the child will be claimed as a dependent on the parties' federal income tax return.

Alimony paid by one spouse to another is a murky area of Nevada law since unlike child support, there is no defined formula to determine how much should be paid and for how long. The governing statute requires the Judge consider a number of factors including age, duration of marriage, level of education and earning capacity. It generally boils down to the needs of the intended recipient and the ability to pay by the paying party. Alimony is considered taxable income by the recipient and deductable by the payor. We urge all clients to consult with their trusted tax advisor for specific application of tax law to their individual case.

A legal dispute can be costly and while we strive to keep costs and fees to a minimum, sometimes it can get expensive to pursue or defend a claim. If we prevail we ask the court for an award of fees to reimburse the client, however, there is never any guarantee of getting fees awarded nor can we make any promises about the outcome of a dispute. We offer, in select cases, unbundled services which permit a flat-fee basis or, in the more traditional case, services charged by the hour.
